As JORGENS KENNEL EVİL ANIMAL PRODUCTS SANAYİ VE TİCARET LİMİTED ŞİRKETİ (“Jorgens Kennel”), we value the protection of the personal data of our valued commercial customers and would like to inform you within the scope of Personal Data Protection Law No. 6698 (“KVKK”). KVKK No. 6698 was adopted on March 24, 2016, and published in the Official Gazette No. 29677 dated April 7, 2016. Some parts of the KVKK entered into force on the date of publication, while others entered into force on October 7, 2016.

In all personal data processing activities we carry out, we act in accordance with all obligations and principles stipulated in the relevant legislation, especially KVKK No. 6698, and we take the necessary security measures to ensure the secure processing of your Personal Data.

2- Information as Data Controller

In accordance with the KVKK numbered 6698 and as the data controller, your personal data will be recorded, stored, updated, disclosed/transferred to third parties where permitted by legislation, classified and processed in the ways listed in the KVKK within the framework explained on this page.

3- Collection of Your Personal Data

Your personal data may be collected verbally, in writing or electronically, through automatic or non-automatic methods within the scope of Jorgens Kennel's commercial activities, through our website, social media channels, parties with whom we have business relationships and/or from whom we receive services complementary to our activities, contracted organizations and other similar channels.

Pursuant to KVKK No. 6698, the personal data you share with Jorgens Kennel may be processed by us, in whole or in part, automatically or non-automatically, provided that it is part of any data recording system, by obtaining, recording, storing, changing, or rearranging the personal data. In short, any transaction performed on the personal data under the KVKK is considered "processing of personal data."

4- Purposes and Legal Reasons for Processing Your Personal Data

We process the personal data you share for the purposes listed below:

  1. To be able to fulfill the requirements of the services we provide to our customers in accordance with the requirements of the contract and technology, and to improve our products and services;

  2. To record the identity, address and other necessary information to identify the transaction owner within the scope of the Law on Regulation of Electronic Commerce No. 6563, the Law on Consumer Protection No. 6502 and the Regulation on Service Providers and Intermediary Service Providers in Electronic Commerce published in the Official Gazette dated 26.08.2015 and numbered 29457, which was prepared on the basis of these regulations, the Distance Contracts Regulation published in the Official Gazette dated 27.11.2014 and numbered 29188, and other relevant legislation;

  • To prepare all records and documents that will form the basis of payment systems, electronic contracts or paper transactions that are mandatory in the field of Banking and Electronic Payments; to comply with the information storage, reporting and notification obligations stipulated by legislation and other authorities;

  1. To provide information to prosecutors, courts and relevant public officials on matters related to public security and legal disputes, upon request and in accordance with the legislation;

  2. Providing you with products and services ordered or purchased through the website, contacting you when necessary, returns, shipping services, establishing a distance selling contract within the scope of electronic commerce, selling, supplying and delivering products or services, receiving your questions and complaints, responding to you, using these in case of a possible dispute when necessary, establishing or performing a contract or fulfilling our legal obligations or establishing or protecting a right;

  1. Processing for the purpose of creating new product and service models, using cookies for this purpose and sending electronic commercial messages if your consent to electronic commercial messages is obtained;

  3. Organizing corporate communications and other events and invitations within this scope and providing information about them.

5- How Your Personal Data Is Collected

Your personal data, in the form of information such as name, surname, address, telephone, work or private e-mail address, through the forms on the Jorgens Kennel website and mobile applications; preferences on the pages accessed using the user name and password, IP records of the transactions performed, cookie data collected by the browser, data including browsing time and details, and location data;

Verbally, in writing or electronically through our channels such as our sales and marketing department employees, branches, suppliers, other sales channels, paper forms, business cards, digital marketing and call center;

Received from persons who share their personal data with Jorgens Kennel for purposes such as establishing a commercial relationship, applying for a job, making an offer, through business cards, CVs, making an offer, and other means, in a physical or virtual environment, face to face or at a distance, verbally, in writing, or electronically;

6- Transfer of Your Personal Data Abroad

Your personal data collected through any of the methods listed above, to be processed in Türkiye or to be processed and stored outside Turkey, may also be transferred to service intermediaries located abroad (to countries accredited by the Personal Data Board and with adequate protection for the protection of personal data), provided that it remains within the scope of the KVKK and in accordance with the contractual purposes.

Your personal data may be transferred to group companies located in the country and abroad, third parties from whom we receive support in areas such as storage, archiving, information technologies (server, hosting, program, cloud computing), security, call center located abroad, companies that provide marketing and sales support, business partners and suppliers from whom we receive services for relevant processing purposes, banks, financial institutions, consultancy firms that receive support in areas such as law, tax, etc., and other related parties and authorized institutions and organizations to which transfer is necessary for the specified purposes, through the processing we carry out in accordance with the processing conditions specified in Article 5 of the KVKK. Furthermore, in the event that a part or assets of Jorgens Kennel (including but not limited to the brand, domain name and other commercial business elements) are sold, based on your explicit consent, your Personal Data may be transferred to the transferee natural or legal persons, their stakeholders, business partners, agents, consultants, and to third parties at home and abroad, including them, to the extent required by the transfer. These third parties may process your Personal Data to a limited extent after the necessary evaluation is made during the transaction process, and in the event of a transfer, the transferee party may continue to process your Personal Data, which is the assets and the values ​​attached to these assets, as the data controller.

Jorgens Kennel is obligated to protect the systems and databases that house your personal data from unlawful processing, to prevent unauthorized access, and to implement software and physical security measures, such as access management. If it becomes known that personal data has been obtained by others through unlawful means, the situation must be reported immediately, in accordance with legal regulations, and in writing to the Personal Data Protection Board.

8- Keeping Personal Data Updated and Accurate

Pursuant to Article 4 of the Personal Data Protection Law, Jorgens Kennel is obligated to keep your personal data accurate and up-to-date. In order for Jorgens Kennel to fulfill its obligations under applicable legislation, it is necessary for our customers to share accurate and up-to-date data or update it through the website/mobile application.

9- Rights of Personal Data Owners According to KVKK No. 6698

Article 11 of the KVKK No. 6698 entered into force on October 7, 2016, and in accordance with the relevant article, the rights of the personal data owner after this date are as follows: The personal data owner may apply to Jorgens Kennel (data controller) and request the following;

  • Learning whether personal data is being processed,

  • To request information regarding the processing of personal data,

  • To learn the purpose of processing personal data and whether they are used in accordance with their purpose,

  • Knowing the third parties to whom personal data is transferred, either domestically or abroad,

  • To request correction of personal data if it is processed incompletely or incorrectly,

  • Request the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7 of the KVKK,

  • To request that, in case of correction, deletion or destruction of personal data, these operations be notified to third parties to whom personal data has been transferred,

  • To object to the emergence of a result against the person himself/herself by analyzing the processed data exclusively through automated systems,

  • In case of any damage caused by the unlawful processing of personal data, the person has the right to demand compensation for the damage.

While no fees are charged for these requests, Jorgens Kennel reserves the right to charge a fee based on the fee schedule determined by the Personal Data Protection Board.

The data owner accepts that if he/she requests that any of his/her personal data not be used by Jorgens Kennel, he/she will not be able to fully benefit from the operation of the website and declares that he/she will be responsible for any liability arising from this.
